EMIR: ESMA agrees MoUs on CCPs with Brazil, Japan, India, Dubai and UAE
Wednesday 29 March 2017 Clifford ChanceESMA has established five Memoranda of Understanding (MoUs) under the European Market Infrastructure Regulation (EMIR). The MoUs establish cooperation arrangements, including the exchange of information, regarding central counterparties (CCPs) which are established and authorised or recognised in Brasil, Japan, India, the Dubai International Financial Center or the United Arab Emirates, and which have applied for EU recognition under EMIR.
EMIR provides for cooperation arrangements between ESMA and the relevant non-EU authorities whose legal and supervisory frameworks for CCPs have been deemed equivalent to EMIR by the EU Commission.
The MoUs are applicable as per their dates of signature.
